Complaints to the Danish Protection Agency

The Act on Processing of Personal Data is under the authority of the Danish Data Protection Agency and it is the agency’s duty to ensure that the law is abided by.

You should always begin by contacting the authority, company, organisation or person you feel is subjecting you to processing of data in violation of the Act on Processing of Personal Data. You must obtain their explanation of the situation.

If the issue concerns something on a social network or debate forum, always begin by contacting the responsible party for the social network or debate forum.

After doing this, you can consider whether you require an assessment of the issue from the Danish Data Protection Agency.

Another person can make a complaint on your behalf if you give this person authorisation, but the processing of data you wish to make a complaint about must relate to you personally.

For example, you can submit a complaint if you feel that:

  • You are not receiving the data to which you are entitled pursuant to the rules on access to data
  • Data about you has been unlawfully posted on the internet
  • Data about you has been unlawfully transferred to a third party
  • You have been unlawfully registered as a bad payer and the credit information agency refuses to delete you from their register

Note that it takes time for the Danish Data Protection Agency to process a case. Therefore, always begin by attempting to solve your problem or obtain the answer to your question by contacting the responsible authority, company, organisation or person.
